1. Purpose
These General Terms of Use and Sale, hereinafter referred to as the “Terms”, govern access to and use of the Appy Bonsai application, its associated web services and the features provided by APPY BONSAI.
They also govern, where applicable, the provision of the Appy Bonsai Premium service.
These Terms apply to users acting in a personal capacity. Specific terms may apply to services provided to professionals or partners.

3. Acceptance
Creating an account or using services that require an account implies acceptance of these Terms.
Where a paid subscription is offered, the essential terms of the offer, including its price, duration, any promotional periods and renewal conditions, are presented to the user before the purchase is confirmed.
The applicable version of the Terms is the version accepted by the user at the time of the relevant subscription or use, subject to any changes that may lawfully be applied to the contract.
4. User account
The user undertakes to provide accurate information and to keep the information required for the operation of their account up to date.
The account is personal.
The user must keep their login credentials confidential and notify APPY BONSAI as soon as possible if they suspect fraudulent or unauthorized access to their account.
The user remains responsible for the normal use of their account, except where such use results from a failure attributable to APPY BONSAI or from an event for which the user cannot legally be held responsible.
5. Minor users
Use of Appy Bonsai by a minor must comply with the rules relating to contractual capacity and data protection applicable in their country of residence.
Where authorization or parental consent is required under applicable law, the minor may not use the relevant features without such authorization.
APPY BONSAI may take appropriate measures where it is established that an account was created in breach of these rules.
6. Description of the service
Appy Bonsai notably allows users to manage collections and information relating to bonsai and other associated items, record photographs and events, plan certain operations, consult information relating to plant species and use various management and cultivation support tools.
Certain features may allow users to voluntarily share specific information or content with other people.
The exact list of features may change over time.
7. Free version
A free version of the service is offered with certain quantitative or functional limitations defined within the application.
These limitations may change without affecting rights acquired under an ongoing paid subscription.
8. Appy Bonsai Premium
Appy Bonsai Premium provides access to the additional features or capacities presented in the application at the time of subscription.
The exact characteristics of the applicable offer are those displayed to the user before purchase.
9. Prices
The applicable prices are those displayed on the distribution platform or subscription interface at the time of purchase.
They may vary depending on the country, currency, applicable taxation, type of subscription or conditions offered by the platform.
Where a promotional offer, free period or reduced price is offered, its duration and the price applicable after it ends are stated before subscription.
Any price change applying to a future renewal will be handled in accordance with applicable regulations and the rules of the relevant distribution platform.
10. Payment
Subscriptions purchased within the application may, in particular, be billed by Apple or Google.
APPY BONSAI does not receive the full number of the bank or payment card used with these platforms.
However, APPY BONSAI may receive the transaction information required to activate and manage the Premium service, including the transaction or subscription identifier, the subscribed product, the subscription status and the associated dates.
11. Subscription renewal
Where a subscription is offered with automatic renewal, this feature is indicated to the user before purchase.
Unless cancelled before the renewal date in accordance with the rules applicable to the platform used, the subscription will be renewed for the period indicated at the time of subscription.
Users are invited to consult their App Store or Google Play account settings to check the renewal date and manage their subscription.
12. Cancellation
A subscription purchased through the App Store or Google Play must generally be cancelled through the platform used for the purchase.
Deleting the application or deleting an Appy Bonsai account does not necessarily cancel a subscription managed by Apple or Google.
Users must therefore separately cancel their subscription with the relevant platform if they wish to stop its renewal.
Cancellation prevents future renewals but does not necessarily result in a refund for the period already paid, subject to any rights provided by applicable law.
13. Expiry of Premium access
When Premium expires, features requiring a subscription become unavailable or limited in accordance with the characteristics of the free version.
APPY BONSAI endeavors to preserve user data in accordance with the retention rules set out in the Privacy Policy.
The expiry of a Premium subscription therefore does not automatically result in the immediate deletion of user data.
14. Right of withdrawal and refunds
Applicable withdrawal or refund rights depend in particular on the user's country of residence, the type of service and the subscription channel.
Where the subscription was purchased through Apple or Google, certain refund requests may need to be submitted directly to the platform that processed the transaction.
Nothing in these Terms deprives a consumer of any right of withdrawal, refund, termination or any other mandatory protection available under applicable law.
15. Legal guarantee of conformity
Consumers benefiting from French or European legislation applicable to digital services are entitled to the statutory guarantees provided by that legislation.
For a digital service supplied continuously, APPY BONSAI is liable for any lack of conformity arising during the period in which the service is supplied under the contract.
The legal guarantee of conformity notably includes the right to have the service brought into conformity under the conditions provided by law and the obligation to provide the updates necessary to maintain such conformity.
Where the legal conditions are met, the consumer may also be entitled to a price reduction or to terminate the contract.
These rights may be exercised at no cost to the consumer.
Mandatory legal provisions applicable in the consumer's country of residence remain fully applicable.
16. Updates
APPY BONSAI may release updates intended, in particular, to improve features, correct defects, maintain service compatibility or ensure its security.
Certain updates may be necessary to maintain the conformity or security of the service.
Users are encouraged to keep the application and their device's operating system up to date.
Where required by law, APPY BONSAI informs the user of the availability of necessary updates and the possible consequences of failing to install them.
17. Compatibility
The application requires a compatible device, operating system and, for certain features, an Internet connection.
Technical requirements may evolve to take account of developments in operating systems, security requirements and the technologies used.
APPY BONSAI does not guarantee indefinite compatibility with hardware or operating systems that have become obsolete, subject to applicable legal obligations.
18. User data and content
Users retain ownership of the texts, photographs and other content they add to their account, subject to any rights held by third parties.
The user grants APPY BONSAI a non-exclusive, worldwide and royalty-free license, limited to what is necessary to host, back up, display, transmit and technically process such content in order to provide the requested features.
This license does not grant APPY BONSAI any right to commercially exploit the user's personal photographs independently of the operation of the service.
19. Public sharing
Where a user voluntarily chooses to make a record, photograph or other information publicly accessible, they acknowledge that such content may be viewed by third parties who have, in particular, the corresponding link or QR code.
The user is responsible for the content they choose to make public and must in particular ensure:
- that they hold the necessary rights;
- that they do not infringe the rights of third parties;
- that they do not publish personal data relating to a third party without a lawful basis;
- that the content complies with applicable law.
Users may use the available features to stop sharing where those features allow this.
20. Prohibited content
In particular, it is prohibited to use Appy Bonsai services to knowingly publish, transmit or store:
- manifestly unlawful content;
- content infringing a third party's intellectual property rights;
- fraudulent content or content impersonating a third party;
- malicious software or content;
- content intended to compromise the security or operation of the service;
- unlawfully obtained data;
- or any content whose distribution is prohibited by applicable law.
21. Reporting and moderation
Content accessible through Appy Bonsai and considered unlawful may be reported to:
The report must make it possible to precisely identify the content concerned and explain the reasons for the report.
APPY BONSAI may remove or make content inaccessible where such action is necessary to comply with the law, protect users or enforce these Terms.
Where required by applicable law, the user concerned will be informed of the measure taken and the reason for it.
22. Prohibited uses of the service
In particular, it is prohibited:
- to attempt to access an account, server or system without authorization;
- to circumvent security or access-control mechanisms;
- to carry out unauthorized scraping or large-scale automated data extraction;
- to deliberately disrupt the operation of the service;
- to transmit malicious software;
- to use Appy Bonsai for unlawful activities;
- to resell or commercially exploit the service without authorization.
23. Horticultural information and assistance tools
The technical, scientific or horticultural information provided by Appy Bonsai, including information relating to species, substrates, cultivation requirements, fertilization, treatments, schedules or climatic conditions, is provided as information and as assistance tools.
Results may depend on many factors that Appy Bonsai cannot know or control, including the condition of the tree, its history, its microclimate, the exact characteristics of the products or substrates used and the user's practices.
The user therefore remains responsible for cultivation decisions made on the basis of this information.
This provision does not limit the statutory guarantees relating to the operation of the digital service itself.
24. Availability and maintenance
APPY BONSAI uses reasonable means to ensure the operation of the service.
However, the service may be temporarily unavailable due, in particular, to maintenance, an update, a technical incident, a security incident, a service provider failure or an external event.
APPY BONSAI does not guarantee absolute or uninterrupted availability of the service, subject to its legal obligations, including those relating to the conformity of digital services.
25. Backup and export
Users remain responsible for retaining any information they wish to keep independently of the service where export or backup mechanisms are made available to them.
This provision does not release APPY BONSAI from its obligations regarding the retention, security, return or recovery of data where such obligations arise from law or contract.
26. Suspension or closure of an account
APPY BONSAI may temporarily suspend or, in serious cases, close an account in the event of:
- fraudulent use;
- a security compromise;
- a serious or repeated breach of these Terms;
- manifestly unlawful use of the service;
- or where such action is legally required.
Where circumstances permit, the user will be informed in advance and may submit observations.
A disproportionate measure will not be taken where a less restrictive measure can reasonably resolve the issue.
27. Account deletion
Users may request or initiate deletion of their account in accordance with the methods available within the application or by contacting APPY BONSAI.
Deleting the account results in the deletion or anonymization of data in accordance with the Privacy Policy, subject to information that APPY BONSAI must retain in order to comply with a legal obligation, establish or defend a right, combat fraud or comply with a mandatory retention period.
Deleting the account does not automatically cancel a subscription billed and managed by Apple or Google.
28. Liability
APPY BONSAI is liable for damage attributable to it in accordance with applicable law.
However, APPY BONSAI cannot be held liable for damage directly attributable to:
- use of the service contrary to these Terms;
- incorrect information provided by the user;
- use of an incompatible device or system;
- an external event that APPY BONSAI could not reasonably prevent or avoid;
- or a third-party service over which APPY BONSAI has no control.
Nothing in these Terms excludes or limits any liability or guarantee that cannot legally be excluded or limited.
29. Personal data
The processing of personal data carried out in connection with the service is described in the Appy Bonsai Privacy Policy.
30. Changes to the service
APPY BONSAI may modify or develop the service for reasons including functional, regulatory, technical or security considerations.
Where a change substantially affects a digital service paid for by the consumer, the consumer benefits from the rights provided by applicable law.
31. Changes to the Terms
These Terms may be amended in particular to take account of:
- changes to the service;
- regulatory developments;
- improvements to the guarantees provided to users;
- technical or security requirements.
Significant changes affecting users' rights or obligations will be brought to their attention within a reasonable period where necessary.

33. Governing law
These Terms are governed by French law.
However, where the user acts as a consumer and resides in another country, this choice of law does not deprive them of any mandatory protection afforded by the law that would have applied in the absence of that choice.
34. Jurisdiction
In the event of a dispute, the applicable legal rules on jurisdiction shall apply.
A consumer may in particular be entitled to bring proceedings before the competent courts of their place of residence where applicable law so provides.
Nothing in these Terms may impose a particular jurisdiction on a consumer where such an allocation of jurisdiction is prohibited by a mandatory provision.
35. Severability
If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.
36. Languages
These Terms may be made available in several languages.
In the event of any discrepancy between translations, the French version shall be the reference version to the extent permitted by applicable law.
This provision shall not deprive a consumer of rights arising from information that was legally required to be provided to them in another language.
